Toy Association Advocates on Proposed Toy Safety Regulations in Chile

November 30, 2021 | Working in collaboration with its International Committee, The Toy Association continues to make progress on global regulatory issues impacting the play community.

On November 29, the Association submitted comments to Chile’s Ministerio de Salud (Ministry of Health or MINSAL) regarding the country’s newly proposed toy safety regulations, which raise concerns of creating potential trade barriers for toys that are contrary to the World Trade Organization’s Technical Barriers to Trade (TBT) agreement.

“As they currently stand, many of Chile’s newly proposed regulations will not work to improve the safety of toys but will instead lead to more unnecessary and costly work for our members to comply and conform to these regulations,” said Alan Kaufman, senior vice president of technical affairs at The Toy Association. “The Toy Association, along with the advisement of our International Committee, provided recommended actions MINSAL can take to remedy these issues and create a more effective and streamlined path to assure the availability of safe toys in the Chilean market.”

Regarding the proposed regulations, The Toy Association is calling for the acceptance of foreign lab certifications and the withdrawal of costly marketing, QR code, and sample certification requirements specific to the Chilean market among other recommendations.
