FDA Update for Manufacturers of Children’s Play Cosmetics
May 5, 2023 | The Toy Association is alerting members that the Food and Drug Administration (FDA) will hold a virtual public meeting on Thursday, June 1 at 10 a.m. (Eastern) to consult all industries affected by the Modernization of Cosmetics Regulation Act of 2022 (MoCRA), which was signed into law late last year.
The new regulations will affect any toymakers that produce, import, or sell items such as DIY makeup and fragrance kits, temporary tattoos, face paint, play cosmetics, and more.
As the FDA has not yet rolled out the framework for registration and compliance, the upcoming public meeting will begin to provide more information regarding one of several topics from the new regulation that have not yet been fully defined.
During the “Good Manufacturing Practices for Cosmetic Products Listening Session,” the FDA will consult cosmetics manufacturers, including smaller businesses, contract manufacturers, consumer organizations, and other experts to inform the agency’s efforts in developing regulations to establish good manufacturing practices for facilities that manufacture or process cosmetic products distributed in the U.S. The FDA broadly defines “cosmetics” as “articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body ... for cleansing, beautifying, promoting attractiveness, or altering the appearance.”
The Toy Association has been monitoring regulation updates related to MoCRA and will be attending the meeting. Anyone interested in joining is required to register before the session begins.
MoCRA is a major change to the FDA’s current regulatory framework for cosmetics, which amends Chapter VI of the Federal Food, Drug, and Cosmetics Act (FDCA). Key provisions will take effect on or by December 29, 2023.
