Supreme Court to Hear Trump Tariffs Case in November
September 10, 2025 | The Toy Association™ issued an alert to members as soon as the news broke on September 9 that the U.S. Supreme Court granted certiorari on an expedited basis to hear two cases challenging the legality of President Trump’s unprecedented use of the International Emergency Economic Powers Act (IEEPA) to impose blanket tariffs on foreign imports.
Here’s what members should know:
- By putting the cases on a highly expedited schedule with oral arguments starting the first week of November, the justices indicated that they likely would resolve the issue quickly.
- The Trump administration is urging a rapid decision.
- Tariffs at issue include the reciprocal tariffs announced April 2 and 25% tariffs on certain imports from Canada, China, and Mexico, tied to fentanyl enforcement.
- Previously, lower court rulings (Court of International Trade and U.S. Court of Appeals for the Federal Circuit) found the tariffs unconstitutional; a separate U.S. District Court ruling reached the same conclusion.
- The tariffs remain in effect during Supreme Court review.
