Toy Association Advocates for Harmonized Regulatory Framework to Address Inconsistent State Laws

The Toy Association™ submitted comments on September 15 in response to the U.S. Department of Justice’s Request for Information (RFI) on “State Laws Having Significant Adverse Effects on the National Economy or Significant Adverse Effects on Interstate Commerce.” The Association’s submission highlights how a patchwork of state regulations, particularly around packaging, chemical reporting, and outdated product restrictions, creates unnecessary burdens for toy companies while doing little to improve consumer safety.

U.S. Court of Appeals Rules Global Reciprocal & Emergency Tariffs Issued under IEEPA are Illegal

The U.S. Court of Appeals for the Federal Circuit has affirmed a lower court ruling (the May 28, 2025 U.S. Court of International Trade ruling) that tariffs imposed under the International Economic Emergency Powers Act (IEEPA) by the Trump Administration are unlawful.

The Toy Association™ issued an alert to members as soon as the news broke on September 9 that the U.S. Supreme Court granted certiorari on an expedited basis to hear two cases challenging the legality of President Trump’s unprecedented use of the International Emergency Economic Powers Act (IEEPA) to impose blanket tariffs on foreign imports.

U.S. Tariff Increase on Chinese Goods Delayed by 90 Days

President Trump has signed an executive order that delays the planned increase of U.S. tariffs on Chinese goods by 90 days. The higher tariffs, originally set to take effect at midnight on August 12, will now be implemented no earlier than November 10, 2025.
